NextGenFile offers a web-based solution to automate legal administrative tasks, specifically the filing of Leave of Absence (LOA) requests across multiple jurisdictions. We provide a platform for attorneys/lawyers to manage their filings seamlessly while staying compliant with local and state laws.

• Account Information: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
• Compliance: You agree to use NextGenFile in compliance with all applicable laws and regulations, including those specific to legal filings in your jurisdiction.
• Accurate Information: You must provide accurate and up-to-date information when using our Services. Any discrepancies may result in rejection or delays in filing.

You are granted a limited, non-exclusive, non-transferable license to access and use NextGenFile’s Services solely for legal filing purposes in accordance with these Terms. You agree not to:

• Use the Services for unlawful purposes.
• Reverse engineer, duplicate, modify, or create derivative works from the Services.
• Interfere with or disrupt the functionality or security of our platform.

We strive to maintain a high level of availability and reliability. However, we do not guarantee uninterrupted service and are not responsible for any unavailability due to technical issues, scheduled maintenance, or other factors beyond our control. NextGenFile integrates with various county-specific e-filing systems. By using our Services, you acknowledge and accept the following:

• Third-Party Platforms: NextGenFile is dependent on third-party systems (e.g., PeachCourt, Odyssey). We are not responsible for their performance, availability, or compliance.
• Compliance Assurance: We strive to keep our platform up-to-date with the latest legal requirements. However, it remains the user’s responsibility to verify compliance with their specific jurisdiction.
• Authorized User Status: You confirm that you have the legal authority to delegate filing permissions to NextGenFile for the purpose of leave-related submissions. By using this service, you acknowledge that you are granting NextGenFile Authorized User Status, allowing NextGenFile to file Leave of Absence(s) in your name. You will provide us with your account credentials for e-filing platforms provided. If these credentials are subject to change, you are in charge of updating accordingly.

• Subscription Term: NextGenFile offers various subscription plans based on usage needs. Detailed pricing and plans are provided on our website.
• Billing and Refunds: All fees are due immediately with the purchase of the subscription service. Failure to do so could result in the termination of your subscription. Refunds are only offered if the user faces a system-wide technical issue preventing them from utilizing the Service. Refund requests must be submitted within 30 days of the issue occurring.
• Method of Payments: Users will be set to pay via Stripe services, offered on our website. Please refer to Stripe’s Terms of Service.

• Data Encryption: We value your privacy and are committed to protecting your personal information. For details on how we collect and manage data, refer to our Privacy Policy.
• Data Encryption: All sensitive information is securely encrypted using industry-standard measures. We implement role-based access controls and monitor for any unauthorized access or breaches.

All rights to NextGenFile’s software, content, and technology are owned by NextGenFile or its licensors. These Terms do not grant any rights to use any trademarks, logos, or branding used in our Services without prior written permission.

NextGenFile and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:

• Inaccurate or incomplete filings.
• Outcomes regarding whether leave requests are approved, rejected, or processed within a certain timeframe.
• Disruptions in service availability or failures in third-party e-filing systems.
• Unauthorized access to your account or data breaches beyond our control.
• Third party service integrations functioning correctly. Users are encouraged to review data submitted through third-party integrations, as we are not liable for any errors, omissions, or delays resulting from third-party services.

We reserve the right to suspend or terminate your access to our Services at any time if:

• You breach these Terms ogr any other guidelines provided.
• We are required to do so by law or under any regulatory directive.

NextGenFile reserves the right to update these Terms periodically. Any changes will be communicated via email or website notifications. Continued use of the Services after updates constitutes your acceptance of the revised Terms.

These Terms and your use of the Services will be governed by and interpreted in accordance with the laws of the State of Georgia, without regard to its conflict of laws principles.
